SUNDAY, APRIL 8

12:37 a.m. A 37-year-old Bainbridge Island man was arrested for driving under the influence.

Police observed the man driving with his high beams on, followed his vehicle, and saw him driving erratically, speeding and crossing both the fog and center lines.

When asked for insurance, the driver scrolled through several emails on his phone to show police an electronic proof of insurance. After the officer acknowledged it was good, he again began perusing emails for another 15 seconds before showing them the proof again. Police said they did not need to see it twice, but asked for his registration, which he provided.

When asked, the man said he’d had two beers.

He did poorly on field sobriety tests. When asked to take a breathalyzer test, the man said, “Do I really have to do it?”

The officer said no, the man could not be made to perform a breathalyzer test.

“Then no,” the man said, and refused.

He was arrested.

After being read his rights, the man was asked if he understood them. “No,” he said. “I don’t.”

Police offered to read them again, and the man began cursing at them.

Police again read the man his rights and asked if he understood.

“Eat [expletive],” he said. “Don’t care.”

Later, the man apologized for being rude, saying he thought the officer was going to shoot him.

The officer explained he had no intention of doing that.

At the station, the man asked to speak to his lawyer, and she was called. He still refused to supply breath samples and so a court order was requested to obtain a blood sample. It was granted and samples were taken before the man was transported to jail.

Throughout, he refused to sign any paperwork or receipts.
