SUNDAY, NOV. 18
1:25 a.m. A 53-year-old Bainbridge man was arrested for driving under the influence.
A Bainbridge officer, while leaving the station parking lot to go on patrol, saw a silver Honda Pilot turn right out of the Windermere parking lot onto Olympic Drive. The car turned too sharply and drove off the raised curb, and the driver appeared slouched forward in his seat. The officer followed, and observed the man speeding and swerving. He also came to a stop in the middle of the Winslow Way/Madison Avenue intersection before proceeding west on Winslow Way.
The officer stopped the car. The driver smelled strongly of alcoholic beverages and his eyes were bloodshot and watery. He told police he’d had a couple of Olympia beers at a blues concert in Seattle.
He performed poorly on the field sobriety test.
When asked if he would be willing to perform a breathalyzer test, the man hesitated. At this point another man, who identified himself as the driver’s friend and attorney, approached. He said he did not trust the machine and insisted that if the officer did not already have probable cause the driver should not blow into it.
When asked again if he’d be willing to perform a breathalyzer test, the driver told the officer he shared his concerns and was going straight inside and to bed.
The officer told the driver he was not free to go, asking once more if he’d perform a breathalyzer test. He refused and was told he would be arrested for DUI.
At this point the friend/attorney asked if the driver could perform the breathalyzer test before being arrested. The officer agreed. The driver blew a .089. The attorney again said he did not trust the device and asked the test be done again. The officer complied. The driver again blew a .089.
The man was arrested and ultimately transported to Kitsap County Jail, where was booked and his bail set at $5,000, as he had no previous offenses. His vehicle was impounded.
