Woman Slaps Teenage Driver: Is It Assault?

BULLETIN – Judge Nystrom last night (Tuesday) found Mrs. McLaren guilty of disorderly conduct, assessed witness costs of $4 but suspended not only a fine of $15 but also court costs of $2.75. In a written finding, the judge said: “Having knowledge of conditions existing on the roadway in question, the court considers the conduct of defendant was perhaps a build-up of apprehension which was focused upon plaintiff’s car which was identifiable beyond other cars, and was subject to defendant’s psychological protest which could have been effective with a scolding without the physical slapping.”

Whether to find a Point White woman, who slapped a teenager’s face because she was so upset at his driving on the Point White Road, guilty of third-degree assault was the problem being weighed by Justice of the Peace Wilbur Nystrom this week.

Judge Nystrom heard testimony April 4 on the not guilty plea of Mrs. Donald McLaren, accused in a complaint signed by Harold Helm, Fletcher Bay, of striking Mr. Helm’s son, Larry, a Bainbridge High School student.

Neither side disagreed on these facts. Mrs. McLaren, deeply concerned over what she said is reckless driving and speeding by teenagers on the Point White Road, telephoned young Helm to come to her house after he had driven past it several times March 31. He did. She “lectured” him on his driving and slapped his face.

The Helms contend the slap was injurious to Larry. Mrs. McLaren’s attorney, noting that Larry’s face bore no sign of injury at the hearing, argued that Mrs. McLaren was not guilty of assault. The judge took the case under advisement.

Film Strip Set For High School P-T A

“Your Child’s Intelligence,” a colored film strip, will be show to the Bainbridge High School Parent-Teacher Association at 8 o’clock Monday evening in the high school library. There also will be a nominating committee report.

Parents of eighth-grade students have been invited to attend. Refreshments will be served.
