The encounter began when the woman stopped to look at a home for lease, having raised her children in the area. She began talking with a man who was moving out of a nearby house. The woman recalled how her children used to play in a large holly tree near the road, and both the woman and the man crawled inside the tree. According to the woman, the man then tried to kiss her but she rejected his advances, so he exposed himself to her. The woman crawled out of the tree, drove away and called police. The man told police that he had actually rejected sexual advances from the woman while in the holly tree but later changed his story. A report was forwarded to prosecutors.

8:29 p.m. Officers stopped to investigate a black Crown Victoria parked with its brake lights on in a lot off Ferncliff Avenue near High School Road. The vehicle matched the description given in an earlier report of possible drunk driving. Using a flashlight, officers saw a man slumped in the driver’s seat wearing a baseball uniform. A key fob and keys were in his hand. An officer yelled at the man and shook his shoulder. At length, the man sat up and immediately tried to start the car, ignoring the officers. He finally gave up and put the keys on the seat. The man smelled faintly of intoxicants and an officer asked if he had been drinking. “I am not driving and my wife is coming to get me,” the man responded. He used the same response to answer all subsequent questions. The man agreed to field sobriety tests but then became combative and demanded to see his wife, whom he said was a lawyer. The man was arrested for physical control of a vehicle while intoxicated. During booking the man continually asked to consult his wife as his legal council, but despite repeated calls from the police, the wife did not appear. It was later determined that the wife was actually a legal secretary. The man was eventually released to his wife.
